Copyright And Intellectual Property

1. Our Artwork

Miuvia creates and sells digital artwork using AI-assisted creative processes, combined with human creative direction, selection, refinement and digital preparation.

Each artwork is reviewed and prepared by Miuvia before being offered for sale.

The use of AI-assisted tools does not mean that customers receive ownership of the artwork or permission to redistribute the digital files.


2. Copyright and Other Intellectual Property Rights

Copyright and other intellectual-property rights may apply to the Miuvia website, branding, artwork, text, product images, graphics and other materials.

The extent to which copyright protection applies to AI-assisted artwork can depend on the nature and extent of human creative contribution and the laws applicable in the relevant jurisdiction.

Miuvia does not represent that every element of every AI-assisted artwork is protected by copyright in every country.

Where Miuvia has intellectual-property rights in an artwork or other material, those rights are retained by Miuvia or the applicable rights holder.


3. What You Purchase

When you purchase a Miuvia digital artwork, you purchase a licence to use the digital product according to the applicable permitted-use terms.

You do not purchase ownership of the underlying artwork or intellectual-property rights unless a particular product expressly states otherwise.

Your purchase does not give you the right to claim the artwork as your own.


4. Personal Use

Unless the product description or licence states otherwise, purchased artwork may be used for personal, non-commercial purposes.

This may include downloading the artwork and making permitted personal prints for your own use.

The purchase does not give you permission to use the digital files to create products for sale or other commercial purposes.


5. What You May Not Do

Unless expressly permitted by the applicable licence, you may not:

  • Resell the digital files.
  • Redistribute the files.
  • Share the files with other people.
  • Give the files away as a free download.
  • Upload the files to file-sharing services.
  • Upload the files to websites where others can access them.
  • Make the files available through social-media downloads or other public repositories.
  • Use the files to create products for resale.
  • Use the files as part of another commercial product.
  • Claim the artwork as your own creation.
  • Sell or licence the digital files to another person.
  • Remove applicable copyright, ownership or licensing information.
  • Circumvent technical measures designed to protect the digital files.

6. Printing

Unless a particular product licence states otherwise, you may make prints of purchased artwork for your own personal use.

You may not sell, distribute or commercially exploit those prints.

Purchasing a digital artwork does not give you permission to operate a print-on-demand service, sell posters or other physical products featuring the artwork, or otherwise commercially reproduce the artwork.


7. Commercial Use

Commercial use is not automatically included with a standard Miuvia purchase.

If a product is offered with a commercial-use licence, the product page or accompanying licence will state the additional rights granted and any applicable restrictions.

Where no commercial licence is provided, the artwork is for personal use only.


8. Sharing and Redistribution

Your purchase is intended for your own permitted use.

You may not share the purchased digital files with friends, family, customers, colleagues or other third parties.

If another person wants to use the artwork, they should obtain their own licence or purchase where appropriate.


9. Website Content and Miuvia Branding

The Miuvia name, logo, website design, written content, product descriptions, photographs, mockups, graphics and other original website materials may be protected by intellectual-property rights.

You may not copy, reproduce, modify or commercially exploit these materials without appropriate permission.


10. AI-Assisted Artwork and Third-Party Rights

Miuvia uses AI-assisted creative tools as part of its production process.

AI systems may be subject to their own terms of use and licensing conditions. Miuvia takes reasonable steps to use its creative tools in accordance with the applicable terms governing those tools.

Because laws and legal interpretations concerning AI-generated and AI-assisted material continue to develop, the legal status of particular AI-generated elements may vary between jurisdictions.

Miuvia therefore does not make a blanket representation that every AI-generated element contained in an artwork is independently copyright-protected in every jurisdiction.


11. Human Creative Contribution

Miuvia’s creative process may include human decisions concerning:

  • Creative direction
  • Subject and style selection
  • Selection of generated results
  • Composition
  • Refinement
  • Editing
  • Image preparation
  • Upscaling
  • Cropping and formatting
  • Product selection
  • Arrangement of artwork into collections
  • Preparation of final customer files

The nature and extent of human involvement may vary between individual artworks.

Where applicable law recognises copyright or other intellectual-property protection arising from human creative contribution, Miuvia reserves those rights to the extent that they exist.

The U.S. Copyright Office currently recognises that AI-assisted creation does not automatically prevent copyright protection where sufficient human authorship determines expressive elements, while merely providing prompts is generally not sufficient by itself.


12. Copyright Notices

Where appropriate, Miuvia may identify its rights through copyright notices or other ownership information.

The absence of a copyright notice does not necessarily mean that material is free to copy or use.

Copyright protection in many countries arises automatically when qualifying works are created, although the requirements and scope of protection vary by jurisdiction.


13. Reporting an Intellectual-Property Concern

If you believe that a Miuvia product or other material infringes your intellectual-property rights, please contact us.

Please provide enough information for us to understand:

  • The material concerned
  • The intellectual-property right you believe has been infringed
  • Why you believe your rights have been infringed
  • Where the material appears on the Miuvia website
  • Your contact information
  • Any supporting information reasonably necessary to investigate the matter

Miuvia will review legitimate concerns and take appropriate action where necessary.


14. Unauthorised Use of Miuvia Artwork

If Miuvia becomes aware that its digital artwork is being distributed, resold or commercially exploited without permission, we may take appropriate action to protect our rights.

This may include requesting removal of unauthorised copies, restricting access to affected accounts, contacting relevant platforms or service providers, or pursuing other remedies available under applicable law.


15. International Copyright

Miuvia operates internationally.

Copyright and other intellectual-property laws differ between countries, and the protection available for AI-assisted artwork may not be identical everywhere.

Miuvia does not intend this policy to make legal claims about copyright protection in a jurisdiction where those claims would not be supported by applicable law.

Where applicable, international copyright conventions and national laws may provide protection for qualifying works outside South Africa. Copyright protection can extend internationally through agreements such as the Berne Convention, although the precise scope and duration of protection are determined under applicable law.


16. No Transfer of Intellectual Property

Purchasing a digital product from Miuvia does not transfer:

  • Copyright
  • Trademark rights
  • Ownership of the underlying artwork
  • Rights to redistribute the digital files
  • Commercial reproduction rights
  • Other intellectual-property rights

except where a specific licence expressly grants such rights.


17. Licence After Refund

If a purchase is refunded or otherwise cancelled, any licence granted in connection with that purchase may terminate to the extent permitted by applicable law.

You must cease using the refunded product and delete or destroy copies where required by the applicable terms or law.

Mandatory consumer rights remain unaffected.


18. Changes to This Policy

Miuvia may update this policy when our products, creative processes, licences, technology or applicable laws change.

The Last Updated date at the beginning of this policy will indicate when it was most recently revised.
